Z uwagi na fakt, iż usługi serwisu Praca.pl świadczone są drogą elektroniczną w rozumieniu ustawy z 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną, wymogiem prawa jest, aby zasady użytkowania tego serwisu uregulowane zostały w regulaminie. Prosimy o zapoznanie się z treścią poniższego regulaminu, gdyż jest on prawnie doniosłym źródłem Państwa, jak i naszych praw i obowiązków w związku z korzystaniem z zasobów serwisu Praca.pl. Regulamin określa jednostronnie wzajemne prawa i obowiązki i nie ma możliwości indywidualnego ich ustalania lub zgłaszania zastrzeżeń do jego treści. Rozpoczęcie korzystania z serwisu Praca.pl równoznaczne jest z akceptację przez Państwa zasad przewidzianych w poniższym regulaminie oraz warunków jakie musicie Państwo spełnić chcąc korzystać z Serwisu i to według stanu treści regulaminu z chwili wchodzenia (logowania się) do serwisu, co oznacza, iż w przypadku jakichkolwiek zmian wprowadzanych jednostronnie do regulaminu, zmiany te obowiązują automatycznie z chwilą każdorazowego odwiedzenia serwisu. Niniejszy regulamin dostępny będzie w tym miejscu przez cały okres istnienia serwisu Praca.pl.
Terms of Service
I. General information
- The present Terms of Service define the rules of functioning and usage of internet portal posted under the web address: www.praca.pl, further referred to as Portal and determines the scope of rights and obligations of the users of Portal, further referred to as Users who consists of private and legal entities and other units without legal status who are located or have a representative on the territory of the Republic of Poland.
- The owner and administrator of the Portal is Praca.pl Ltd., whose registered office is located in Warsaw (00-493) at 2 Bolesława Prusa Street, further referred to as Administrator whose rights and obligations related to the administration of the Portal and the relations to its users are determined in the Terms of Service.
- Portal www.praca.pl is a registered press title published daily in the internet in the electronic version only. The chief editor is Krzysztof Kirejczyk. Editorial office is located in the Administrator seat.
- The Portal delivers and publishes the information, offers, and databases related to the labour market, trainings, education, upgrading qualifications and job-seeking skills and also other information relevant for the labour market.
- Every advice and information containing characteristics of an advice published on the Portal or on internet forum available through the Portal is not directed at individual recipients and does not meet their individual situation but they are just a general collection of information gathered and available in one location at the Portal. They can also consist of the Users' statement for which the Administrator cannot be held responsible.
II. The conditions of participation and the terms of use of the Portal
- The participation of every User is voluntary and possible after the registration and creation of an account on Portal which is done by the procedure of registration.
- Registration at Portal is synonymous with the User's compliance with:
- the use of means of electronic communication (here: internet) in order to deliver Portal services;
- I accept the Terms of Service as a whole, without any exceptions and reservations in this matter;
- processing personal data by the Administrator to the extent of which they were entered during the process of registration and for further use of services while complying with the Personal Data Protection Act of 29 October 1997 (consolidated text: Journal of Law of 2002, no 101, item 926 with further amendments).
- receipt of commercial information from the Administrator or his partners or distributed by them on the commission of third parties.
- "Using the Portal and its services is possible after entering the required data by the User or payment of charges for the access to the given service. This is being decided by the User when giving the required data or paying the charges. Depending on the scale of fulfilment of the above conditions the Administrator grants the User the access to the range of services and resources that is defined by the scope of meeting the requirements needed for their usage.
- Every User can at any time resign from the further participation in the Portal by deleting the account individually which has the effect of deleting all information and data about the User from every location in the Portal and also from the servers where the data is stored with the reservation that the Administrator can keep the User's data in the scope and time that is legally allowed for the purpose of fulfilment of the commitments between the User and Administrator
- The technical conditions that must be met to register and use the Portal are:
- individual e-mail account,
- browser Internet Explorer version 5.5 or higher or other compatible browsers,
- the browser must accept the "cookies" files which contain information saved by the server of the Portal on the Users computer in order for the server to read the information when re-identifying another connection from the computer. "Cookies" files can be read by other servers, devices and people operating in internet when the configuration of the browser is incorrect. The mechanism of the "cookie" file is widely used by many internet portals. If the browser does not accept the "cookie" files you still can operate in the Portal but this may interfere with its functioning.
- One User can create only one account in the Portal.
- It is forbidden to pass on to third parties the login and password that allow to access the Portal. Every User should in his own interest keep the above information secret as every owner of that data will be able to access the Portal and make unauthorised changes in the account for which the Administrator cannot be held responsible.
- The Administrator can create and delete Users' accounts in order to disable or limit access to selected or all services and resources of the Portal if the User violates the Terms of Service, generally binding legal acts, the rules of social intercourse, or acts to the detriment of other Users or the legitimate interest of the Administrator and third parties.
- Particular services of the Portal are payable or free, dependent on the Administrator's decision.
- The information about the charging of the service, its price, and conditions of providing the service is posted by the Administrator in the Portal in a location most suitable with respect to the location of the given service itself and the access to the location.
- All the services of the Portal may be changed in relation to its content and scope, added or eliminated, and also temporary suspended or its access may be limited according to unimpeded decision of the Administrator without any possibility of filing a complaint in this respect.
- The Administrator reimburses the services costs if the Administrator or his co-operators are the only ones to blame for the reimbursement.
- The Administrator reserves the right to apply permanent or temporary discounts to the services of the Portal.
III. Submission and publication of advertisements in the Portal
- The content of the advertisement is submitted electronically to the Administrator by the means of electronic forms available in the Portal.
- The publication of the advertisement may depend on the payment of the charge or the verification by the Administrator or other parties co-operating with him of the existence of the entity that submitted the advertisement. The verification can be performed by requesting specified documents or statements in a form indicated by the Administrator.
- Independently of any provisions of the Terms of Service the final decision concerning the publication of every advertisement is made by the Administrator. In case of a refusal of publication of an advertisement, which has already been paid for by the User the Administrator will reimburses the paid charge after deducting the handling costs which are composed of transfer costs, money order, correspondence costs or other which the Administrator will bear.
- One advertisement may contain up to 250 words. A word is a group of signs (letters, numbers, symbols etc.) with space between them.
- Every punctuation mark before the first word of the advertisement or in-between words without space is treated as a separate word.
- Every punctuation mark placed in-between a word separates it into two words.
- The Administrator does not ensure the publication of an advertisement in the User's graphical arrangement or processing.
- The advertisements are published in sections of the Portal to which they were directed by the User in the appropriate part of the advertisement submission form.
- It is forbidden to place in the advertisement or anywhere in the Portal a content which is illegal, which exhorts to discrimination because of gender, ethnicity, race, sexual orientation, age, disability, religion, which has vulgar, obscene character or is controversial in any other way or which violates personal goods, subjective rights of other persons or entities, which have the form of penal acts or infringement against public order as well as content that promotes and gives instructions concerning illegal activity;
- The Administrator reserves the right to moderate the content of the advertisements or refuse to publish an advertisement without justifying it when the content of the advertisement violates the Terms of Service, generally binding legal acts, and the rules of social intercourse. Nevertheless the Administrator cannot be held responsible for the content of the advertisement their truthfulness, reality, integrity or the existence of the entity that submitted the advertisement.
IV. Personal data protection
- In relation to the participation in the services offered by the Portal the Users' personal data, that was submitted voluntarily, is gathered and processed in the resources of the Portal. The administration of the above data is given to the Administrator that is Praca.pl Ltd. in compliance with the Personal Data Protection Act of 29 October 1997
- The request of deletion of all personal data from Portal is understood as resignation from the further usage of the Portal resources as a whole or from the individual services.
- The detailed rules of personal data processing, the scope of the User's rights and the Administrator's obligations in the respect of personal data processing are laid down and explained in the Attachment No 1 "Privacy policy" to the Terms of Services.
V. Complaints
- The disruption in the functioning of the Portal, problems and comments concerning the Portal's services may be the subject of the User's complaint which can be filed to the Administrator by the following e-mail: pomoc@praca.pl
- The filed complaints will be considered at once but not longer than in 14 days from the day of filing the complaint by the team of the Portal. However the Administrator reserves the right to leave a complaint unanswered if it is a result of an ignorance of the Terms of Service, or a result of not complying with the Portal's or Administrator's advices.
- The complaints addressed to the Administrator but concerning the services offered by third parties through the Portal will be immediately directed to the responsible entities.
- The Administrator reserves the right to interfere into the technical structure of the User's account in order to diagnose irregular functioning of the Portal's services. The administrator can also change or influence the technical side of the User's account in order to modify it or restore proper functioning of the account itself or the whole Portal.
VI. Changes of Terms of Service and its availability
- Any resolution in the Terms of Service may be unilaterally changed by the Administrator without giving reason for it. The amendments will be published without any delay in the format of consolidated text of the Terms of Service on the Portal together with the information on the amendment.
- After the publication on the main page or other suitable location in the Portal the information about the amendments to the Terms of Services, the User should immediately familiarize himself with it because logging in to the Portal after the publication is considered as acceptance of the amended content of the Terms of Service by the User.
- In the case of refusing to accept the amended Terms of Service the User should restrain himself from logging in to the Portal and immediately inform the Administrator about this decision.
- Refusing to accept the amendments to the Terms of service will lead to the deletion of the User's account from the Portal.

VII. Concluding dispositions
- The Administrator cannot be held responsible for the content published on the Portal by the Users nor for the content's truthfulness, reality, or integrity.
- The Administrator cannot be held responsible for incidents and events that may happen in the real world between the Users regardless of the cause.
- The Administrator cannot be held responsible for the truthfulness of information and data entered by the Users into the Portal or the information about the Users which were made available to other Users - the Administrator has no possibility of verifying it with reality.
- The Administrator will not popularise in any other way than it is foreseen for the purposes of this Portal and the scope of given statements the Users' personal data to any third parties without legal basis obligating the Administrator to do so. The Administrator assures that he takes all precautions to protect the Users' data, in particular in all ways provided for in the Personal Data Protection Act of 29 October 1997 and in the regulations issued on its basis.
- The Administrator as the owner and manager of the Portal makes every effort to assure the proper and continuous functioning of the Portal and the services offered by its medium. However the Administrator is not responsible for any interference caused by act of God or forbidden interference of the Users or third parties.
- The Administrator reserves the right to temporary shot down the whole or part of the Portal in order to improve, add services or perform maintenance of the system without notifying the Users earlier.
- The Administrator cannot be held responsible for the "account thefts" done by third parties and also for the downloading of the content published by the Users on the Portal and on other www sites or its other usage by the third parties for the Administrator hasn't got the power to totally block the possibility to copy content from the Portal.
- The Administrator cannot be held responsible for the loss of content from the Portal caused by failure of equipment, web dysfunction, caused by third parties or act of God.
- The Administrator reserves the right to publish on the Portal the information about the Users who persistently violate or persistently undertake action which are contradictory to the Terms of Service or the goal and character of the Portal.
- The Administrator reserves the right to publish without giving personal details the Users messages addressed to the Portal's team (FAQ) concerning the functioning of the Portal and the given advice when the Administrator finds their content worth publication.
- It is forbidden to copy, duplicate or use in any other way information or its pieces published on the Portal without the written assent of the Administrator with the exception of the cases allowed by the act of 4 February 1994 on Copyright and Neighbouring Rights (Journal of Law of 1994 No 24 item 83).
- The Administrator reserves the right to implement within the Portal functional, identifying or other solutions which will be appropriate for the object and technical conditions of the Portal to counteract any undesirable behaviours or occurrences that can threaten rights and interests of the Users, the Administrator or the subjective rights of other entities with relation to the character of a medium such as the internet (i.e. development of new technologies that may become a threat, extensiveness, lack of possibility of verifying the content with reality, and anonymity etc.). In particular the Administrator reserves the right to mark in different ways and with different characteristics the Users' materials dedicated to be published on the Portal in order to indicate that they origin from the Portal which should counteract the misuse of the materials by entities not authorised. Every user can ask the Administrator to cease using these solutions towards his materials but the Administrator may refuse to do so only if they could violate the subjective rights of the Administrator or third parties.
- The Administrator reserves the right to reassign in part or entirely all his rights and obligation connected with the Portal without seeking the agreement of the Users or the right to any objections made by the Users.
