Terms of Service of the Praca.pl website

PART A. GENERAL PROVISIONS

I. DEFINITIONS

The terms used in these Terms of Service have the following meaning:

  1. Terms of Service – these “Terms of Service of the Praca.pl website”;

  2. Service Provider – Praca.pl sp. z o.o. having the registered office in Warsaw (00-493), ul. Bolesława Prusa 2, entered into the Register of Entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under the KRS number 0000290935;

  3. Website – the www.praca.pl website maintained by the Service Provider;

  4. User – a Candidate, an Employer, an Exhibitor or a Participant using the Website based on an Agreement concluded with the Service Provider;

  5. Employer – an entity other than a consumer, which has accepted these Terms of Service and for which the Service Provider provides Services;

  6. Public Employer – an Employer whose identity is disclosed to the Candidates on the Website;

  7. Hidden Employer – an Employer whose identity is not disclosed to the Candidates on the Website;

  8. Candidate – a natural person using the Website in order to reach a potential Employer;

  9. Registered Candidate – a Candidate who has successfully registered on the Website and created a Candidate Account;

  10. Unregistered Candidate – a Candidate who has not registered on the Website, using the Services that do not require registration and creating a Candidate Account;

  11. Registration form – a form available on the Website that enables registering a Candidate Account or a Fair Profile in the Subdomain;

  12. Candidate Account – an account on the Website in which the Candidate enters his/her data regarding education, career, etc. The Account may be used to submit Applications for specific Advertisements of Public or Hidden Employers;

  13. Candidate Profile - a functionality of the Account enabling a Registered Candidate to enter selected data regarding education, career, etc. The Profile may be used to submit Applications for specific Advertisements of Public or Hidden Employers (Profile application);

  14. Employer’s Panel – a profile on the Website, in which the Employer enters its data and information necessary to conduct recruitment, and through which an Employer may view Applications and information on Candidates;

  15. Services – services provided electronically by the Service Provider to Employers, Candidates, Exhibitors or Participants, the scope of which is set out in the Terms of Service;

  16. Services for Employers – the services listed in the Terms of Service, provided by the Service Provider to Employers under the Agreement;

  17. Services for Candidates – the services listed in the Terms of Service, provided by the Service Provider to Candidates;

  18. Agreement – an agreement for the provision of Services concluded by and between the Service Provider and a Candidate, an Employer, an Exhibitor or a Participant under the Terms of Service (in the case of Services for Employers the Agreement may also have a form of an order);

  19. Advertisement – an Employer’s advertisement on recruitment for a specific position, posted on the Website;

  20. Subscription of offers – a service provided on the basis of an Agreement with the Candidate, consisting in informing the Candidate periodically about job offers posted on the Website corresponding to the selection criteria defined by the Candidate;

  21. Application – all personal data and information sent by a Candidate to an Employer who commissioned placing an Advertisement via the Website, including, but not limited to: curriculum vitae (CV), cover letter and personal data of the Candidate;

  22. Praca.pl Fair - an event organized by the Service Provider, taking place on the date and in the place specified on the Website;

  23. Exhibitor – each entrepreneur, as defined in the Act of 2 July 2004 on the freedom of business activity, running a business and seeking employees, using the Subdomain and presenting job offers at the Praca.pl Fair;

  24. Participant – a natural person other than an Exhibitor, using the Subdomain, seeking a job at the Praca.pl Fair;

  25. Registered Participant – a Participant of Praca.pl Fair who has successfully registered in the Subdomain and received an own Fair Profile;

  26. Subdomain - a subdomain of the Website to serve the Praca.pl Fair, available at www.targi.praca.pl;

  27. Fair Profile – a professional profile created by a Participant in the Subdomain;

  28. Price List – a detailed list of prices for paid Services, available on the Website at: https://www.praca.pl/nasze-uslugi;

  29. Provision of Electronically Supplied Services Act – the act of 18 July 2002 on the provision of electronically supplied services (consolidated text: Journal of Laws 2017, item 1219);

  30. Copyright and Related Rights Act – the act of 4 July 1994 on the copyright and related rights (consolidated text: Journal of Laws 2017, item. 880);

  31. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);

  32. Personal Data Protection Act – the act of 10 May 2018 on the protection of personal data.

II. RANGE OF SERVICES

  1. Praca.pl provides services consisting in making the Website available to Employers in order for them to search for Candidates in the recruitment process, and in making the Website available to Candidates in order for them to search for a job, as well as in making the Website available to Exhibitors and Participants as part of the Praca.pl Fair. The detailed scope of the services provided to Employers and Candidates is specified in Part B and Part C, and to Exhibitors and Participants - in Part D of the Terms of Service, respectively.

  2. The services are supplied electronically on the www.praca.pl Website, and via the Praca.pl mobile application.

III. TERMS AND CONDITIONS FOR THE PROVISION OF SERVICES

  1. The basic technical requirements necessary to use the Website:

    1. Internet connection,

    2. Internet browser that enables displaying HTML documents on the computer screen: Internet Explorer - 11 or newer version, Google Chrome, Mozilla Firefox, Safari, or another browser compatible with the Website; the browser should accept "cookies".

  2. Using the Website with a mobile device via the mobile application is possible, provided that the mobile application has been correctly installed on the device.

  3. Using some of the Services requires having a Candidate Account, an Employer Panel or a Fair Profile.

  4. It is necessary to have an e-mail account to create or use a Candidate Account, an Employer Panel and a Fair Profile.

  5. The Service Provider stipulates that using the Services may involve the standard risk related to using the Internet and recommends that the Users take the appropriate measures to minimize this risk.

  6. Employers, Candidates, Participants and Exhibitors are banned from supplying unlawful content and content infringing the principles of good conduct. In particular, they are banned from using vulgarisms, supplying untrue content, imputing, insulting, using hate speech.

IV. CONCLUSION AND TERMINATION OF THE AGREEMENT

  1. The agreement for the provision of Services for a Candidate is concluded via the Website.

  2. The agreement for the provision of Services for an Employer may be concluded on the Website or outside of it.

  3. The agreement for the provision of Services for an Exhibitor is concluded via the Website.

  4. Before concluding the Agreement, the Service Provider provides the Terms of Service to the Users, free of charge.

  5. The detailed principles of concluding and terminating Agreements between the Service Provider and Candidates, Employers, Exhibitors and Participants, respectively, are specified in Part B, Part C or Part D of the Terms of Service, respectively.

  6. Within 14 days following the conclusion of an Agreement, the Candidate/Participant may withdraw from the Agreement for convenience, without any costs. A declaration of withdrawal reading: “I declare that I am withdrawing from Agreement [...] with Praca.pl, pursuant to Part A, item IV, section 6 of the Terms of Service”, must be submitted electronically to the e-mail address: biuro@praca.pl.

V. COMPLAINTS

  1. In the case of finding any irregularities in the functioning of the Website, the User may file a complaint, by sending an e-mail message to the following address: reklamacje@praca.pl, or by post, to the following address: ul. Bolesława Prusa 2, 00-493 Warszawa, within 14 days following the occurrence of the event being the subject of the complaint.

  2. The Service Provider will consider the complaint within 14 days and provide a reply, which will be sent to the User's address specified in the Registration Form.

VI. PERSONAL DATA

§ 1

Personal data Controller and information duties of the Controller - Art. 13 of the GDPR

  1. [Controller] The Controller of the personal data of registering Candidates, Registered Candidates, Candidates who have signed up for the Subscription of offers, and employees of Employers, is the Service Provider - Praca.pl sp. z o.o., having the registered office in Warsaw (00-493), ul. Bolesława Prusa 2, entered into the Register of Entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under the KRS number 0000290935. The Controller hereby provides the contact details: e-mail address rodo@praca.pl, telephone number 22 5671600, correspondence address: ul. B.Prusa 2, 00-493 Warszawa.

  2. [Personal Data Protection Officer] The Controller has appointed the Personal Data Protection Officer and hereby publishes his contact details aimed for communication regarding the personal data: e-mail address rodo@praca.pl, telephone number 22 5671600, address: Praca.pl Data Protection Officer, ul. B.Prusa 2, 00-493 Warszawa.

  3. [Purpose and Basis] Personal data is collected and processed for the purpose of implementing Agreements concluded between the Service Provider and Candidates, Employers, Exhibitors or Participants, pursuant to Art. 6 section 1 item b of the GDPR. Personal data is also collected and processed on the basis of Art. 6 section 1 item f of the GDPR (legitimate interests) for the purpose of direct marketing of the Service Provider's Services, as well as stored for the purpose of seeking claims (legitimate interest of the Controller).

  4. [Recipients] Personal data is made available to recipients indicated, respectively, in § 2 and § 3 below.

  5. [Processing period] Personal data is processed until the termination of the Agreement, and then stored until the end of the period of prescription for claims resulting from the Agreement.

  6. Users are entitled to lodge complaints to the supervisory body.

  7. Users may request access to their personal data, its rectification, deletion, limitation of processing, or they may oppose the processing and transfer the data. However, execution of some requests, i.e. deletion, opposition, transfer of data, prevents the implementation of the Agreement and results in its termination.

  8. Requests regarding the processing of personal data should be submitted to the e-mail address of the Personal Data Protection Officer provided in item 2 above.

  9. Personal data is processed in a non-automated way. No profiling takes place.

  10. The Controller has developed and implemented the Personal Data Security Policy consistent with the GDPR.

§ 2

Personal data of Candidates and Participants - detailed part

  1. Prior to registration, the Controller processes the following personal data of Candidates/Participants: first name, surname, e-mail address, IP address;

  2. The Controller processes the following personal data of Registered Candidates/Participants: first name, surname, date and place of birth, contact details (e-mail address, telephone number, address of residence), IP address, and information provided by the Candidate in his/her CV (concerning education, career history and experience, qualifications, knowledge of foreign languages, type of job sought, and other information provided in the Candidate’s CV).

  3. The personal data is collected from the Candidate/Participant, that is the data subject.

  4. The Candidates/Participants provide their personal data voluntarily, however, a failure to provide such data prevents the implementation of the Agreement.

  5. [Purpose and basis] Personal data collected prior to or during registration and subscription to Subscription of offers is processed in order to conclude an Agreement with the Service Provider, pursuant to Art. 6 section 1 item b) of the GDPR.

  6. The personal data of Registered Candidates/Participants is processed for the purpose of implementing the Agreement, under Art. 6 section 1 item b) of the GDPR.

  7. Personal data is also collected and processed on the basis of Art. 6 section 1 item f of the GDPR for the purpose of direct marketing of the Service Provider's Services, as well as stored for the purpose of seeking claims (legitimate interest of the Controller).

  8. The Service Provider sends a welcome message to the e-mail address provided during registration (or during Application without registration - in case of selecting the Subscription of offers option). The welcome message includes an activation link with particulars of the Controller and other information required by Art. 13 of the GDPR, and information that the personal data provided for registration is processed until the Candidate/Participant clicks on the activation link, and the data provided after a successful registration is processed in order to implement the Agreement.

  9. [Provision of data] Personal data of Candidates/Participants is made available to Employers (Public Employers or Hidden Employers), or to relevant Exhibitors, looking for candidates for specific positions, according to the criteria selected by such Employers/Exhibitors.

  10. Upon the transfer of Candidate’s/Participant's personal data and CV to a specific Employer, the Employer becomes the controller of the Candidate’s/Participant's personal data and from that moment on all duties of a controller resulting from the GDPR rest with the Employer/Exhibitor.

  11. In the case of a Candidate applying for an Employer's Advertisement posted on the Website using the Employer's external form (§ 4 in Part B), the Employer, not the Service Provider, is the controller of his/her personal data.

§ 3

Personal data of employees of Employers and Exhibitors - detailed part

  1. The Controller processes the following personal data of employees of Employers/Exhibitors dedicated to implement the Agreement: first name, surname, contact data (e-mail address, telephone number), IP address.

  2. The personal data is collected from Employers/Exhibitors on the basis of an agreement concluded by and between the Service Provider and the Employer/Exhibitor.

  3. [Purpose and Basis] The personal data collected is processed for the purpose of implementing the Agreement concluded between the Service Provider and Employers/Exhibitors and ensuring contact, under Art. 6 section 1 items b) and f) of the GDPR.

  4. [Provision of data] Personal data may be provided to external entities providing accounting services for the Service Provider.

PART B. PROVISION OF SERVICES FOR CANDIDATES

§ 1

Services and Agreement

  1. The Service Provider provides Services for Candidates consisting in giving access to the Website with the purpose of seeking a job.

  2. Candidates may apply in the following way:

    1. Unlogged Users - via the Praca.pl application form;

    2. Logged Users (Registered Users) - via the Praca.pl application form;

    3. via Employer's external form.

§ 2

Applying via the Praca.pl application form as an Unlogged User

  1. In order to apply for a specific Advertisement posted on the Website, the Candidates:

    1. complete the Praca.pl application form, stating their personal data: first name, surname, e-mail address;

    2. accept the Terms of Service;

    3. attach files with their CV/cover letter to the Application.

  2. Under the “send” button, the Candidates read a message that their data is processed by the Service Provider in order to be transferred to the Employer, and that until that moment the Service Provider is the Controller of the Candidate's personal data.

  3. The Candidate's personal data, together with the attached files referred to in section 1 item c above, is stored for the duration of the browser session used by the Candidate, and available during subsequent Applications made by the Candidate within this session. The session ends with closing of the browser by the Candidate.

  4. Upon sending of the Application, the Candidate’s personal data along with attached files are sent to the Employer Panel. The Employer becomes the controller of the Candidate's personal data.

  5. After sending the Application, the Candidate receives an automatically generated confirmation of sending of the Application to the e-mail address provided, including: the specification of the Advertisements applied to together with the names of files attached to the Application, and information concerning the Controller (the Service Provider - until the moment of sending the data to the Employer Panel and generating a confirmation), and other information required in Art. 13 of the GDPR.

  6. When applying, the Candidate may choose to create a Candidate Account. In such a case the Candidate registers and creates the Candidate Account in accordance with § 3 below. If the Candidate chooses to create the Candidate Account, his/her personal data and files attached to the Application and referred to in section 1 item c above are saved on the Candidate Account.

  7. The candidate may check an optional consent for the Service Provider to send commercial information by e-mail.

  8. The candidate may check an option of Subscription of offers. In such a case the Candidate completes the Subscription as described in § 5 below.

  9. When applying via the Praca.pl application form, the Candidate concludes an Agreement with the Service Provider consisting in the Candidate using the Website provided by the Service Provider for online Application. The Agreement covers:

    1. the Candidate applying for an Advertisement;

    2. confirming the Application by e-mail.

    and is concluded until the Candidate's application is confirmed by the Service Provider.

§ 3

Application via the Praca.pl form as a Logged User (Registered User)

  1. In order to create a Candidate Account (registration of a Candidate), the Candidate:

    1. completes the Praca.pl registration form, stating his/her personal data: e-mail address, password;

    2. accepts the Terms of Service;

    3. chooses the “register” option.

  2. Under the “register” button, the Candidate reads a message that a successful completion of the registration process means the conclusion of an Agreement with the Service Provider.

  3. A password is required containing at least 8 characters, including at least one uppercase letter and one number.

  4. The candidate is obliged not to disclose the Password to third parties, and bears the sole responsibility for any damage caused as a result of such a disclosure.

  5. The Service Provider sends a welcome message to the e-mail address provided during registration. The welcome message includes an activation link with particulars of the Controller and other information required by Art. 13 of the GDPR, and information that the personal data provided for registration is processed until the Candidate/Participant clicks on the activation link, and after clicking on the link, for the purpose of implementing the agreement and for legitimate interests of the Controller. After clicking on the activation link, the Candidate/Participant is registered on the Website (the Candidate Account is created) and the Agreement is concluded.

  6. The Agreement with a Candidate covers:

    1. keeping an active Candidate Account;

    2. provision of information about the Candidate to Employers, including his/her CV/cover letter;

    3. modification of personal data by the Candidate;

    4. storing of information about the Candidate in order to look for job offers for him/her;

    5. notifying about job offers - Subscription of job offers.

  7. After creating the Candidate Account, the Candidate may create his/her Profile by entering selected data on education, career history, etc.

  8. The Registered Candidate can apply for specific Advertisements, by attaching files with the CV/cover letter, or via the Profile Application.

  9. After sending the Application, the Candidate receives an automatically generated confirmation of sending of the Application to the e-mail address provided, including: the specification of the Advertisements applied to together with the names of files attached to the Application.

  10. The candidate may check an optional consent for the Service Provider to send commercial information by e-mail.

  11. The candidate has the right to object to the processing of his/her personal data with the purpose of being notified by the Service Provider about job offers. The Subscription service is then deactivated.

  12. The Candidate's Account is removed from the Website, in the following cases:

    1. the e-mail address provided in the Registration Form makes it impossible to contact the Candidate;

    2. lack of the Candidate's activity for a period of 12 months following the registration;

    3. The Candidate violates the essential provisions of the Terms of Service.

§ 4

Application via Employer's external form

  1. In order to apply for specific Advertisements posted on the Website, the Candidate selects the ”Apply” option available in the Advertisement of a Public Employer or a Hidden Employer.

  2. Upon clicking on the “Apply” button, the Candidate is transferred to the Employer’s form, regardless of whether he/she is a Registered Candidate or an Unregistered Candidate.

  3. The Service Provider does not process any of the Candidate's personal data.

  4. The Employer whose Advertisement is applied to is the Controller of the Candidate's personal data.

  5. The Service Provider does not send any e-mail message to the Candidate.

  6. The candidate may check an option of Subscription of offers. In such a case the Candidate completes the Subscription as described in § 5 below.

§ 5

Subscription of offers

  1. The Candidate may order a separate Subscription of Offers service on the Website, by clicking the “Subscribe to offers” icon and providing his/her e-mail address. Under the “Subscribe to offers” button, the Candidate reads a message that a successful completion of the activation process means the conclusion of a Subscription Agreement with the Service Provider, and accepts the Terms of Service.

  2. An automatically generated welcome message is sent to the e-mail address provided by the Candidate. The welcome message includes an activation link with particulars of the Controller and other information required by Art. 13 of the GDPR, and information that the personal data provided for the activation is processed for the purpose of concluding the Agreement until the Candidate/Participant clicks the activation link, and after clicking the link - for the purpose of implementing the Agreement. After the Candidate clicks the activation link, the Subscription Service is activated, which is tantamount to signing a Subscription Agreement.

§ 6

Termination of the Agreement

  1. The Candidate may terminate the Agreement at any time, by logging to the Candidate Account and selecting the “Delete Account” option in the settings or, in case of a separate Subscription of offers, by switching off the last active subscription.

  2. The Service Provider may terminate the Agreement, if the Candidate does not comply with the Terms of Service. The Candidate will be notified about the termination of the Agreement by an e-mail message sent to the address provided in the Registration Form.

  3. Deletion of the Candidate Account in accordance with § 3 section 10 means the termination of the Agreement.

PART C. PROVISION OF SERVICES FOR EMPLOYERS

§ 1

Services and Agreement

  1. The Service Provider provides Services to Employers, consisting of:

    1. providing access to the Employer Panel, in order to use certain Services for Employers;

    2. editorial support and publication of advertisements;

    3. providing access to knowledge;

    4. posting Advertisements at the Employer's order on the Website;

    5. distinguishing Advertisements in a specific manner;

    6. posting the Employer's presentation in the directory of Employers available on the Website;

    7. enabling the receipt of the Candidates’ Applications;

    8. initial selection of Applications according to the Candidates’ level of qualifications;

    9. managing the recruitment process and Applications;

    10. providing access to articles and information relating to the labour market.

  2. The services are provided on the basis of an Agreement concluded on the Website or outside of it.

  3. The range of Services is defined in the Agreement.

  4. The time limit for the Employer to use the Service is 12 months following the date of activating the Service (term of the Agreement), unless the Agreement clearly stipulates otherwise.

  5. If the Agreement provides for placing of Advertisements on the Website, it should be understood as the Service Provider's readiness to post the Advertisements during the term of the Agreement. The Advertisements will be posted on the Website, provided that the Employer enters them and that other conditions resulting from the Terms of Service are met.

  6. The Employer may enter Advertisements:

    1. via the Employer Panel;

    2. by sending them to the Service Provider in a form of an attachment to an e-mail message;

    3. by telephone, by contacting the assistant assigned to the Employer;

    4. in another way agreed by the Service Provider and the Employer.

  7. The Service Provider provides the following additional services - at the Employer's request:

    1. “Offer of the week” distinction - the service consists in placing a link to the Advertisement on the main page of the Website and in the search results, for a period of 7 days;

    2. “Superb Offer” distinction - the service consists in placing a distinctive graphic sign next to the link to the Advertisement on the list of Advertisements;

    3. refreshing of Advertisements - the service consists in shifting the Advertisement once to the top of the list of Advertisements, in place of the latest Advertisement.

  8. For the execution of the Agreement, the Employer will pay the remuneration to the Service Provider, as specified in the Agreement.

  9. The additional services are payable, unless the Service Provider has clearly specified otherwise, or the parties have agreed otherwise. The prices of the Additional Services are defined in the Agreement, or in the price list available on the Website.

  10. An Advertisement cannot contain more than 250 words. A word is a set of characters followed by a space, a punctuation mark or the end of a line.

  11. The Employer suggests the section of the Website in which an Advertisement is to be displayed. The final decision regarding the section in which the Advertisement is to be displayed is made by the Service Provider.

  12. When implementing the Agreement, the Service Provider and the Employer communicate in particular via the Employer Panel and by e-mail.

  13. Before displaying an Advertisement on the Website, the Service Provider may check the compliance of its content with the Agreement, and the compliance of its appearance with the standards of website editing and the style of the Website.

  14. The Service Provider may modify the content of the Advertisement and its parameters (including the definition of the professional area and position), to the extent justified by the need to ensure that the content of the Advertisement and its parameters are reliable, legal, compliant with the Agreement and true to the facts, and not misleading for Candidates.

  15. The period during which an Advertisement is displayed on the Website as valid is determined each time by the Employer and amounts to 14 or 30 days. This period is counted from the moment of activating the Service.

  16. In case of interruptions in the operation of the Website lasting longer than 12 hours, the period for which an Advertisement is placed on the Website is extended by an appropriate amount of time.

  17. After the expiry of the period during which an Advertisement is displayed as valid, the Advertisement is marked as archived.

  18. The Employer may mark an Advertisement as archived before the expiry of the time limit referred to in item 17.

  19. Marking an Advertisement as archived at the Employer’s request does not result in increasing the pool of Advertisements available for the Employer, nor does it constitute a basis for reimbursement of all or part of the remuneration paid for posting that Advertisement.

  20. Marking an Advertisement as archived means that no Applications can be submitted to that Advertisement.

  21. An Advertisement marked as archived is displayed on the Website until it is removed by the Service Provider.

  22. In case of obtaining reliable information that an Advertisement contains illegal content or its publication violates the Agreement, the Service Provider may block the Advertisement. A blocked Advertisement will not be displayed on the Website.

  23. Blocking an Advertisement does not constitute a basis for any claims against the Service Provider, and in particular does not entitle to claim: compensation, reimbursement of remuneration paid for placing the Advertisement, or increasing the pool of Advertisements to be used by the Employer.

  24. (Copyrights) Posting an Advertisement is tantamount to the Employer granting the Service Provider with a free right to use the elements comprising the Advertisement (including the logo, the advertisement content, the graphic layout), to be displayed on the Website, placed in printed publications and advertising materials, without territorial restrictions, for a period of 5 years. After the expiry of the period indicated above, the right is granted for an indefinite period, with a one-year’s period of notice available to the Employer. This right is non-exclusive. The Employer agrees to the sub-license of Advertisements.

  25. The right referred to in section 24 above covers also the right to modify an Advertisement within the scope of editorial changes, and to use a modified Advertisement in the same scope as that defined in item 24.

  26. Posting an Advertisement is tantamount to giving consent for the publication of the Advertisement also on other websites of the Service Provider and of partners cooperating with the Service Provider, for the period specified in section 24.

  27. Immediately after completing the recruitment process, the Employer is obliged to remove from the Employer's Panel all Candidates' Applications that he or she received in relation to the given Advertisement. If the Employer does not delete the Candidates' Applications within this period, they will be automatically deleted after 6 months from the end of publication of the Advertisement, unless the law, court order or decision of the competent authority orders the Service Provider to keep them.

§ 2

Settlements

  1. The Service Provider will issue and send a VAT invoice to the Employer. The Employer agrees for the Service Provider to use electronic invoices, and to receive them by e-mail (this applies to both invoices, and their duplicates and corrections). However, the Employer undertakes to accept invoices in a paper form, when technical or formal obstacles prevent sending electronic invoices.

  2. The remuneration is payable by a bank transfer, to the bank account indicated on the VAT invoice.

  3. The payment deadline is specified in the Agreement, or in the invoice.

§ 3

Communication

  1. When implementing the Agreement, the Service Provider and the Employer communicate in any way agreed by them, in particular via the Employer Panel made available for the Employer, and by e-mail.

  2. The Service Provider may appoint an assistant for the Employer, that is a person responsible for contacts between the Service Provider and the Employer related to the implementation of the Agreement.

  3. The Employer is obliged to secure the access data to the Employer Panel in such a way that only the persons authorized to perform activities relating to the implementation of the Agreement have access to the panel.

  4. Decisions and activities relating to the implementation of the Agreement may be made on behalf of the Employer by all employees and all persons using the e-mail addresses in the Employer's domain.

  5. The Agreement or a written statement of the Employer may limit the circle of persons entitled to make decisions and activities relating to the implementation of the Agreement on behalf of the Employer to certain named persons.

§ 4

Termination of the Agreement

The Service Provider may terminate the Agreement, if the Employer does not comply with the Terms of Service. The Employer will be notified about the termination of the Agreement by an e-mail message sent to the address provided in the Agreement.

PART D. Praca.pl FAIR - Targi.praca.pl subdomain

§ 1

Services

  1. The Service Provider provides the following Services to Participants:

    1. enabling the creation of a Fair Profile;

    2. providing access to the Fair Profile created to Exhibitors, for recruitment purposes, within 6 months following the end of the Praca.pl Fair;

    3. creating the Candidate Account and providing Services on the Website in line with the principles set out in the Terms of Service - Part B;

    4. publication of photos of the Participants taken during the Praca.pl Fair in the Subdomain;

    5. enabling access to expert articles published in the “Strefa Wiedzy” section of the Subdomain;

    6. providing access to the directory of Exhibitors.

  2. The Service Provider provides in particular the following Services to Exhibitors:

    1. enabling access to the Fair Profile;

    2. enabling adding expert articles in the “Strefa Wiedzy” section of the Subdomain;

    3. enabling displaying the Exhibitor's business card in the Subdomain.

  3. The manner of providing the Services referred to in section 4 items b and c for the Exhibitor is specified in the Agreement concluded with the Exhibitor.

  4. Using some of the Services listed in this section requires creating a Fair Profile.

§ 2

Registration and creation of a Fair Profile

  1. The Participant creates a Fair Profile by registering. Registration of the Participant takes place by filling in the Registration Form available in the Subdomain, or by logging in via the Candidate Account, including in the mobile application, or via a LinkedIn account or a Facebook account.

  2. A registration of a Participant in the Subdomain in a different way than by logging in via the Candidate Account is tantamount to registering on the Website.

  3. The Exhibitor receives access to their account after concluding an Agreement with the Service Provider.

  4. The Fair Profile of a Registered Member is deleted, if the Participant requests a deletion of the Fair Profile, immediately after the Service Provider receives such a request. For this purpose, the Participant sends a request to delete the Fair Profile to the e-mail address targi@praca.pl saying “I opt out”. The request to delete a Fair Profile is tantamount to resignation from the further use of the Services for which it is necessary to have a Fair Profile, and to termination of the Agreement.

  5. The Service Provider deletes the Participant's Fair Profile from the Subdomain/Website, if:

    1. the e-mail address provided in the Registration Form makes it impossible to contact the Candidate;

    2. The Candidate persistently violates the essential provisions of the Terms of Service.

  6. Removal of the Fair Profile from the Subdomain/Website is tantamount to termination of the Agreement.

  7. For the Services provided in the Subdomain the relevant provisions of the Terms of Service are applicable, unless they conflict with this chapter.

§ 3

Payment

  1. The Participant's participation in the Praca.pl Fair is free of charge.

  2. The Exhibitor's participation in the Praca.pl Fair is payable. The price of the Exhibitor's participation in the Praca.pl Fair is specified in the Agreement concluded with the Exhibitor.

§ 4

Termination of the Agreement

The Service Provider may terminate the Agreement, if the Participant/Exhibitor does not comply with the Terms of Service. The Participant/Exhibitor will be notified about the termination by an e-mail message sent to the address provided in the Registration Form or in the Agreement, respectively.

PART E. LIABILITY

  1. Each party to the Agreement is obliged to repair the damage suffered by the other party as a result of a non-performance or improper performance of the Agreement, unless the non-performance or improper performance resulted from circumstances for which the party is not liable, in particular due to force majeure.

  2. Neither party is liable to the other party for lost profits.

  3. The liability of the Service Provider for a damage caused to an Employer and an Exhibitor is limited to the amount of the remuneration paid by the Employer or the Exhibitor, respectively, within the implementation of the given Agreement.

  4. In the case of a User violating the Terms of Service, the Service Provider is not liable for any damages resulting from the cessation of the provision of Services/termination of the Agreement, including the effect of deleting the Candidate Account, Employer Panel or Fair Profile.

  5. The Service Provider is not liable for:

    1. Damages caused to third parties as a result of the User using the Services in a manner inconsistent with the Terms of Service or the law;

    2. The content provided by the User as a result of using the Services which violates the law or the interest of third parties protected by the law (including works, as defined by the Copyright and Related Rights Act); In particular, the Service Provider does not verify the content of the Employer's Advertisements, or the content of the Candidate’s CV and cover letter. Therefore, the Service Provider is not liable for the content of such documents;

    3. Publishing the User's image on the Website by the User;

    4. Loss of data by the User, caused by external factors (e.g. a failure), or other circumstances beyond the Service Provider’s control (e.g. actions of third parties), including those attributable to the User;

    5. Damages resulting from the lack of continuity of the Services, as a result of circumstances for which the Service Provider is not responsible, or ceasing the provision of Services in accordance with section 1 of Part F;

    6. Providing false, incomplete or invalid data and information by the User.

PART F. FINAL PROVISIONS

  1. The Service Provider reserves the right to:

    1. Temporarily cease the provision of the Services due to maintenance or modification of the Website. The Users will be informed about such breaks with a notification published on the Website;

    2. Stop the provision of the Services and delete the Candidate Account, Employer Panel or Fair Profile in the case of a violation of the provisions of the Terms of Service or a violation of the law.

  2. If the User places his/her image on the Website, he/she agrees to its free-of-charge recording, reproduction and distribution by the Service Provider during the period of the provision of Services, on the fields of exploitation specified in section 3 below - in accordance with art. 81 of the Copyright and Related Rights Act. The Service Provider declares that the image placed by the User will be used for the proper performance of the Services.

  3. The User who publishes content constituting a work on the Website, as defined by the Copyright and Related Rights Act, declares that he/she holds the copyrights to that work. At the same time, upon placing the work on the Website, the User grants the Service Provider a free-of-charge, non-exclusive and territorially unlimited license, for the period of providing the Services to the User, enabling the use of the work in the fields of exploitation: production, reproduction, public broadcasting and display, entering into the computer memory and server, placing on the Internet.

  4. Any changes to the Terms of Service will be notified to the Users electronically, to the e-mail address provided during registration.

  5. The Terms of Service are made available free of charge to all Website Users, who can download it, display it and record it via the Website.

  6. Any disputes that may arise in the context of the implementation of the Terms of Service or the Agreement will be settled by a court having jurisdiction over the Service Provider’s location.

  7. The Terms of Service enters into force on 25 May 2018.
