Employment agreement is a document in which states the employee's commitment to do a specified type of work for the employer. Signing of the document is a legal act giving the parties certain rights and obligation within the Labour Code. An employment agreement needs to be created in the form of a written document, which needs to be handed by the employer to the employee at latest in the day of the start of work. An employment agreement can be concluded for a trial period, specified period (including an employment contract for a specified task and replacement contract) and as a permanent contract. This type of contract guarantees: stable employment, minimum wage, a right to a paid leave, a right to a paid sick leave, a notice period adequate to the work experience, security for pregnant women and parents on maternity and paternity leaves, social security benefits, a possibility of receiving a mortgage loan for a house of a flat, with the solvency based on the received salary..

An employment agreement must include:

  • page of contract
  • type of contract
  • date of the agreement
  • work conditions
  • salary conditions

Employment agreement has to state the following precisely:

  • type of work
  • place of work
  • the salary is paid for a specific work with the elements of the salary specified
  • work time
  • date of commencing employment

An employment agreement can be terminated:

  • resignation with notice
  • by agreement
  • without notice (a cause and justification have to be indicated, along with a possibility of appeal)
  • after its expiry
  • upon the last day of work, for which it was concluded

Contract of mandate is a civil law contract and is subject to Civil Code. It can be concluded in written an oral form. On the basis of such a contract the contractor agrees to do a specific work for the employer. This type of does not provide employment protection, remuneration protection and the right to paid leave. There are certain limitations resulting from this type of contract, such as the lack of possibility of taking a mortgage loan or taking sickness or maternity benefits (a voluntary type of insurance, which, while reducing labour costs resulting from the contract, is not paid by the contractor). Contract of mandate is popular among people who are already insured (those, who are employed under an employment agreement and for whom the contract of mandate is an additional source of income, eg. students under 26 and women on maternity leaves). Employers value this type of agreement for its lower costs in comparison to an employment agreement. An additional advantage of the contract of mandate is the ability to terminate it at any time. When the contract is is the sole title for insurance, the employer is obligated to pay the ZUS contribution: old age pension, disability and health. If the contract is carried out at the client's offices, the client's also has to pay the accident insurance. Sickness insurance is voluntary. .

A specific task contract is a civil law contract within the Civil Code. Under this type of contract, the contractor agrees to deliver a specific work for the employer, for which the contractor is remunerated. The contract of specific task is flexible, which means that the place and manner of doing the work is up to the contractor's decision, if the contract does not state otherwise. The advantage of this type of contract is the ability to transfer work to a third party, if the contract does not state otherwise. The specific task contract cannot be terminated, but it can be dissolved in situations foreseen in the contract. The work can be tangible and intangible. In the first case it is visible and physically in the world. In the latter case the work is a result of a mental, creative or artistic work. A contractor working under the specific task contract is not obligated to pay any contributions, unless the contractor is also employed by the employer under an employment agreement and the specific task is an additional work. The specific task contract is not subject to ZUS contributions. :
